Company Terms & Conditions

1. Definitions

  • “Company” means Kgari 4×4 Rescue Pty Ltd, ABN [insert].
  • “Customer” means the person or entity requesting services.
  • “Services” means towing, recovery, storage, roadside assistance, or transport.
  • “Vehicle” includes cars, motorcycles, trailers, machinery, or any item transported.

2. Acceptance of Terms

By requesting or accepting services (phone, online, insurance referral, or on-site), the Customer agrees to these Terms & Conditions.

3. Services Provided

  • The Company provides towing, recovery, storage, and roadside assistance.
  • All services are subject to availability, weather, safety, and access conditions.
  • The Company may refuse service if conditions are unsafe or unlawful.

4. Bookings & Authorisation

  • The Customer must provide accurate details about the vehicle and situation.
  • signed Authority to Tow / Consent Form may be required before towing.
  • For private property towing in QLD, a written contract and consent must exist before removal.

5. Pricing & Payment

  • Quotes are estimates only and may change based on:
  • Distance
  • Vehicle type/condition
  • Time (after-hours/public holidays)
  • Recovery complexity
  • Payment is due:
  • At time of service, or
  • Before vehicle release from storage
  • Additional charges may apply for:
  • Waiting time
  • Storage fees
  • Special equipment or recovery

6. Cancellations & Delays

  • Customers must notify cancellations as soon as possible.
  • Cancellation fees may apply if the truck is already dispatched.
  • The Company is not liable for delays caused by:
  • Traffic
  • Weather
  • Accidents
  • Events beyond control

7. Vehicle Condition & Risk

  • The Customer must disclose:
  • Existing damage
  • Mechanical faults
  • Leaks or hazards
  • The Company is not liable for:
  • Pre-existing damage
  • Mechanical failure during towing
  • Minor cosmetic damage from normal transport conditions

8. Liability & Insurance

  • The Company will take reasonable care but:
  • Liability is limited to damage caused by negligence.
  • The Customer is responsible for ensuring:
  • Adequate vehicle insurance
  • The Company is not liable for:
  • Personal belongings left in the vehicle
  • Indirect or consequential loss

9. Storage of Vehicles

  • Storage fees apply daily once the vehicle is held in the Company’s yard.
  • Vehicles may be retained until all fees are paid.
  • Uncollected vehicles may be disposed of in accordance with applicable laws.

10. Customer Responsibilities

The Customer must:

  • Provide legal authority to tow the vehicle
  • Ensure the vehicle is safe to transport
  • Remove valuables before towing
  • Comply with all laws and directions

11. Refusal of Service

The Company may refuse service if:

  • The request is unsafe or illegal
  • The vehicle cannot be accessed safely
  • The Customer behaves abusively

12. Third-Party Services

  • The Company may engage subcontractors where necessary.
  • Additional costs may apply for third-party services.

13. Compliance with Queensland Law

  • All towing operations comply with Queensland tow truck licensing laws.
  • Only accredited drivers and authorised vehicles will be used.

14. Dispute Resolution

  • Disputes should first be raised directly with the Company.
  • If unresolved, disputes may be referred to:
  • Queensland Civil and Administrative Tribunal (QCAT)

15. Privacy

  • Customer information is collected only for service delivery.
  • Data will not be shared except where required by law.

16. Changes to Terms

  • The Company may update these Terms at any time.
  • Updated terms apply to all future services.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia.
